The Bush administration is expected to unveil a new plan Wednesday to change the law so that "unlawful combatants" held at Guantanamo Bay, Cuba, can be tried for crimes before military tribunals.... [*]
The only problem is, there is and should be no such thing. If you are unlawful to the nation's laws you are a criminal and are subject to criminal law. If you are fighting the nation, then you are a prisoner of war. Both categories have legal protections.
BushCo created a new category precisely because they wanted to violate those protections - If you are a prisoner of war you can only be asked name, rank, and serial number. If you are a prisoner you have a right to a lawyer and a speedy trial. BushCo wanted and still wants unlimited detention, questioning and denial of legal access. They were smacked down by the courts and they should be again.
